Culturally Appropriate Considerations

When considering possible restorative justice suggestions as to sentencing, it is important that Aboriginal Offenders not be further traumatized by advancing suggestions that are unrealistic and could result not only in failure but in further charges.

For example, if treatment decisions are made directling the offender to their own community where there are inadequate services, or there are personal barriers that prevent the client from actively participating in their treatment this may increase the possibility of a breach or contribute to the offender committing another crime.

Remember, there is limited funding for on-reserve services for therapeutic and preventative measures  and even for those living off reserve, many urban programs do not have services that can address the historical, cultural or spiritual treatment needs of Aboriginal people.
