Considerations for Gladue Sentencing Principles
The key to assisting the Court in determining a ‘restorative justice’ sentence is uncovering for them what it means to live in an Aboriginal community, possibly live a traditional lifestyle, and understand the social and economic realities of it.
In this module we hope to better understand Issues around the personal circumstances of the the accused and how they impact on the Aboriginal Offender and sentencing considerations.
Why you need to advise the court as to the offenders community, and that communities unique challenges and strengths and how these aspects of this offender’s community apply to the Gladue principles.
How to determine and then express these characteristics in sentencing submissions to the courts on behalf of Aboriginal Offenders.
